Rehabilitation and the stay order

“Nag-file ng rehabilitation ang may utang sa amin. Hindi na ba kami makakasingil?”

Rehabilitation works only if every creditor stops pulling at once. The stay order is that freeze — broad, automatic with the commencement order, and deliberately full of exceptions students forget.

Study material, not legal advice. Written and checked by the PhilippineLaws team to the best of our knowledge; not reviewed by a lawyer. Check every provision and case against its full text before you rely on it or cite it.

Read the strip. The last panel does not answer — you do, before the rule shows up.

A garment factory floor, half the machines idle. The CFO of Sulong Textiles Corp. stares at a stack of demand letters.

CFO

“Tatlong bangko, sabay-sabay nang nagfo-foreclose. Kung kukunin nila ang makina, sarado na tayo.”

Insolvent, but still a going concern. Keep both facts in view.

A courtroom. A judge signs a document titled COMMENCEMENT ORDER.

JUDGE

“Ang lahat ng aksyon para maningil laban sa debtor — suspendido.”

The Stay or Suspension Order is part of the Commencement Order itself.

Outside the courthouse, a bank lawyer on the phone, holding the company president's personal surety agreement.

BANK LAWYER

“Hindi natin masingil ang korporasyon. Pero pumirma si Mr. Santos bilang surety…”

The debtor is protected. Is everyone solidarily bound with it?

Mr. Santos, the president, reading a summons, looking at the reader.

CAPTION

Protektado ang kumpanya. Protektado rin ba ang surety?

Vote before the rule.

Does the stay order stop the bank from suing Mr. Santos on his surety agreement?
