IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 11168, OTHERWISE KNOWN AS "AN ACT ALLOWING HOME ECONOMICS SUBJECTS AND HOME ECONOMICS-RELATED TECHNICAL-VOCATIONAL SUBJECTS IN ALL PUBLIC AND PRIVATE SECONDARY EDUCATIONAL INSTITUTIONS, RESPECTIVELY, CONSISTENT WITH SECTION 8 OF REPUBLIC ACT NO. 10533 OR THE ENHANCED BASIC EDUCATION ACT OF 2013"
The Department of Education (DepEd) hereby issues the following rules and regulations to implement the provisions of Republic Act No. (RA) 11168 titled, "AN ACT ALLOWING HOME ECONOMICS SUBJECTS AND HOME ECONOMICS-RELATED TECHNICAL-VOCATIONAL SUBJECTS IN ALL PUBLIC AND PRIVATE SECONDARY EDUCATIONAL INSTITUTIONS, RESPECTIVELY, CONSISTENT WITH SECTION 8 OF REPUBLIC ACT NO. 10533 OR THE ENHANCED BASIC EDUCATION ACT OF 2013," in consultation with the Commission on Higher Education (CHED) Chairperson, the Technical Education and Skills Development Authority (TESDA) Director-General, and the Professional Regulation Commission (PRC) Chairperson:
SEC. 1.Title--These rules and regulations shall be referred to as the Implementing Rules and Regulations (IRR) of Republic Act (RA) No. 11168, otherwise known as "AN ACT ALLOWING HOME ECONOMICS SUBJECTS AND HOME ECONOMICS-RELATED TECHNICAL-VOCATIONAL SUBJECTS IN ALL PUBLIC AND PRIVATE SECONDARY EDUCATIONAL INSTITUTIONS, RESPECTIVELY, CONSISTENT WITH SECTION 8 OF REPUBLIC ACT NO. 10533 OR THE ENHANCED BASIC EDUCATION ACT OF 2013."
SEC. 2.Scope and Application.--The provisions of this IRR shall primarily apply to all public and private basic educational institutions.
SEC. 3.Declaration of Policy.--This IRR shall be interpreted in light of the Declaration of Policy found in Section 1 of the Act, to wit: "[it] is the policy of the State, as enshrined in the 'Enhanced Basic Education Act of 2013,' to allow graduates and specialists on specific fields that have limited licensed teacher applicants to teach in their specialized subjects for the basic education levels. The State recognizes the invaluable contribution that Filipino professionals and specialists, particularly degree holders of Home Economics, can make to the realization of a literate, skilled and productive citizenry."
SEC. 4.Definition of Terms.--For purposes of this IRR, the following terms shall mean or be understood as follows:
| a. | Allied sciencesrefer to those programs that are in relation or in association with home economics; | |
| b. | Higher Education Institutions (HEIs)refer to an education institution authorized and recognized by CHED to offer bachelor's degree or graduate courses; | |
| c. | Home Economics Graduatesrefer to graduates of non-education baccalaureate degree program that provides a broad foundation in home economics areas and emphasizes the integration of knowledge to focus on following areas: consumer studies, household resource management, entrepreneurship and livelihood development, and related allied courses or programs. This definition includes graduates from degree programs related to or specializing in, but not limited to, the following areas: | |
| i. | Culinary Arts; | |
| ii. | Family Life and Child Development Science in Family Life Development; | |
| iii. | Science in Community Nutrition; | |
| iv. | Food Technology; | |
| v. | Hotel, Restaurant, and Institution Management; | |
| vi. | Clothing Technology; | |
| vii. | Interior Design, and; | |
| viii. | Industrial Education. |
In consultation with CHED and TESDA, DepEd may identify and include other relevant degree programs with different areas of concentration with in the scope of home economics or its allied sciences;
| d. | National Certificaterefers to the document issued by TESDA to individuals after eing subjected to a national Competency Assessment and proven competent in all the required unit of competency of a national qualificatino defined under the promulgated Training Regulation; |
| e. | Provisional teachersrefer to those graduates of Home Economics and allied courses without Licensure Examination for Professional Teachers who have been engaged as teachers to handle home economics, home economics-related and technical-vocational subjects,providedthat those who shall teach technical-vocational subjects in secondary schools shall be required to possess National Certificate I (NC I) and a National Certificate II (NC II); and |
| f. | Training Methodologyrefers to the tools/manner of procedure, especially a regular and systematic way to execute the implementation of the training. |
SEC. 5.Home Economics Teachers Qualification.--In the event of a shortage of licensed teacher applicants for home economics subjects and home economics-related and technical-vocational subjects, as determined by the Secretary of DepEd, competent graduates of home economics or other applied sciences shall be allowed to teach as provisional teachers, as defined in this IRR, for home economics subjects and home economics-related and technical-vocational subjects in all public and private elementary and secondary educational institutions, respectively, and other duly recognized academic institutions.
Home economics graduates or graduates of other allied sciences shall only be considered competent if these graduates have:
| a) | Completed a non-education baccalaureate degree program; |
| b) | Obtained Training Methodology Level 1 certification from TESDA; and |
| c) | For those qualified and enlisted as provisional teachers, taken and passed the Licensure Examination for Teacher (LET) within five (5) years from the date of hiring. |
Provided,That before graduates of home economics be allowed to teach technical-vocational subjects in secondary educational institutions, they shall be required to obtain a NC I and NC II from TESDA.
Providedadditionally, That hired provisional teachers as defined in this IRR shall be appointed to a Teacher 1 position.
Upon the enactment of this IRR, DepEd and Civil Service Commission, in consultation with the TESDA, shall jointly formulate the appropriate standard and guidelines, including academic requirements and competencies to assess the qualifications of Home Economics for the technical-vocational subjects.
RULE III
FINAL PROVISIONS
SEC. 7.Additional Implementing Details/Policies and Guidelines.--DepEd in coordination with TESDA, PRC, and CHED, may issue such orders enumerating the additional implementing details/policies and guidelines necessary to further implement this IRR.
SEC. 8.Amendments.--Amendments to this IRR shall, in consultation with CHED Chairperson, be issued by DepEd.
SEC. 9.Separability Clause.--If any provision of this IRR is held invalid or unconstitutional, the other provisions not so declared shall remain in force and effect.
SEC. 10.Repealing Clause.--All provisions of existing implementing rules and regulations, circulars, department issuances, and procedures corresponding to laws and any other law or parts of law in consistent with this IRR are hereby repealed, amended or modified accordingly.
SEC. 11.Effectivity.--This IRR shall take effect immediately after its publication in theOfficial Gazetteor a newspaper of general circulation,
SEC. 12.Registration.--This IRR shall be registered with the Office of the National Administrative Registrar (ONAR) at the University of the Philippines Law Center, UP Diliman, Quezon City.
