IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 11726, "AN ACT ESTABLISHING THE EDADES AND BERNAL CULTURAL CENTER AND MUSEUM IN DAGUPAN CITY, PROVINCE OF PANGASINAN, DEFINING ITS PURPOSES AND OBJECTIVES, AND APPROPRIATING FUNDS THEREFOR
RULE I
DECLARATION OF POLICY
SECTION 1.Section 15, Article XIV of the 1987 Constitution affirms that Arts and Letters shall enjoy the patronage of the State. The State shall conserve, promote and popularize the nation's historical and cultural heritage and resources, as well as artistic creations.
SEC. 2.To this end, it shall be declared the policy of the State to preserve the works of our national artists and acknowledge their significance in the nation's cultural heritage.
RULE II
ESTABLISHMENT AND PURPOSES OF
EDADES AND BERNAL CULTURAL CENTER AND MUSEUM
SEC. 3.There is hereby established a cultural center and museum in Dagupan City, Province of Pangasinan, to be known as the "Edades and Bernal Cultural Center and Museum," hereinafter referred to as the "Center," in honor of the city's distinguished national artists, Victorio Edades and Salvador Bernal, with the general purpose and objective of presenting and promoting culture and the arts, as well as creative industries in the community. Towards this end, it shall:
a. Research, collect, conserve, interpret and exhibit the lives and artistic achievements of National Artists Victorio Edades and Salvador Bernal;
b. Promote and develop the local creative industries in Dagupan City, Province of Pangasinan and its immediate environs; and
c. Support the promotion and showcase of the Order of National Artists (ONA).
RULE III
MANAGEMENT OF EDADES AND BERNAL CULTURAL CENTER AND MUSEUM
SEC. 4.The Center shall be a collaboration between the City Government of Dagupan and the National Commission for Culture and the Arts (NCCA), herein referred to as the "Commission," with its concerned affiliated cultural agencies and pertinent academic and private sector partners, and members of the community, wit its site, structures, governance, organization, operations, and development to be provided for by mutual agreement between the parties, to be executed and published within one (1) year from the effectivity of this Act.
Within thirty (30) Calendar days upon effectivity of this Implementing Rules and Regulations (IRR), a Technical Working Group (TWG) shall be created, composed of representatives from the City Government of Dagupan and the NCCA, which shall be responsible for the following:
a. Act as the lead body in coordinating and collating inputs from the different stakeholders for the establishment of the Center;
b. Draft the necessary Memorandum of Agreement (MOA) and/or its amendment regarding the Center's site, structures, governance, organization, operations, and development;
c. Ensure the execution and publication of the MOA; and
d. Perform such other functions necessary for the effective implementation of this Act.
SEC. 4.1.Stakeholder Participation.To ensure the successful implementation of the Center's program, projects and activities, the Center shall undertake consultations with other national government agencies and other stakeholders, including, but not limited to, the Department of Education, Department of Tourism, Department of Environment and Natural Resources, National Museum of the Philippines, National Historical Commission of the Philippines, Cultural Center of the Philippines, National Archives of the Philippines, Komisyon sa Wikang Filipino, Film Development Council of the Philippines, National Book Development Board, National Council for Children's Television, Design Center of the Philippines, National Commission on Indigenous Peoples, Philippine Creative Industries Development Council, Higher Education Institutions, the descendants of National Artists Victorio Edades and Salvador Bernal, and other national, regional, and local associations with proven and established track record in the promotion of culture and the arts that may be recommended by the City Government of Dagupan.
RULE IV
SITE, MAIN VENUE AND ANCILLARY OFFICES
SEC. 5.The City Government of Dagupan shall provide the land necessary for the construction or establishment, or both of the main venue and ancillary offices and facilities of the Center. For this purpose, with the power of the Local Government Units (LGUs) under Section 18 of Republic Act No. 7160, or the Local Government Code (LGC) of 1991, and Title II, Chapter 3 of the LGC, the Sangguniang Panlungsod (SP) of Dagupan City shall issue the necessary Resolution and Ordinance, granting the site, main venue and ancillary offices of the Center, within three months from the publication of the MOA, or within the earliest period allowable under the LGU's legislation rules, from the publication of the MOA.
RULE V
BUDGET
SEC. 6.The amount necessary for the implementation of this Act shall be charged against the current year's budget of the NCCA (Proper). Thereafter, such amounts as may be necessary for its continued implementation shall be included in the annual General Appropriations Act.
RULE VI
AMENDMENTS
SEC. 7.Amendments.Any amendments to this IRR shall be approved by the NCCA Board of Commissioners, in coordination with the City Government of Dagupan, other concerned agencies of the government, and private stakeholders.
RULE VII
FINAL PROVISIONS
SEPARABILITY AND EFFECTIVITY CLAUSES
SEC. 8.Separability Clause.If any provision of this IRR is held invalid or unconstitutional, the other provisions not so declared shall remain in full force and effect.
SEC. 9.Effectivity.This IRR shall take effect fifteen (15) days after its publication in theOfficial Gazetteor in a national newspaper of general circulation.
