IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 11772, "AN ACT ESTABLISHING THE BILIRAN CULTURAL CENTER AND MUSEUM IN THE PROVINCE OF BILIRAN, DEFINING ITS PURPOSES AND OBJECTIVES, AND APPROPRIATING FUNDS THEREFOR"



Rule I

ESTABLISHMENT AND PURPOSES OF BILIRAN CULTURAL CENTER AND MUSEUM

SECTION 1. There is hereby established a cultural center and museum in the Province of Biliran, to be known as the "Biliran Cultural Center and Museum" to promote culture and the arts.

SEC. 2. It shall serve as the institutional medium for the protection, preservation, presentation and promotion of the cultural, artistic, archaeological, social, historical, religious and philosophical heritage of the Biliran Island land and its people in view of the richness of their legacies and of their relevance to their contemporary and future aspirations.


Rule II

MANAGEMENT OF BILIRAN CULTURAL CENTER AND MUSEUM

Section 3. The Biliran Cultural Center and Museum shall be a collaboration between the Provincial Government of Biliran and the National Commission for Culture and the Arts (NCCA) with its concerned affiliated cultural agencies and pertinent academic and private sector partners, and members of the community, with its site, structures, governance, organization, operations, and development to be provided for by mutual agreement between the parties, to be executed and published within one (1) year from the effectivity of this Act.

Within thirty (30) Calendar days upon effectivity of this IRR, a Technical Working Group (TWG) shall be created, composed of representatives from the Provincial Government of Biliran and the NCCA which shall be responsible for the following:

a.
Act as the lead body in coordinating and collating inputs from the different stakeholders for the establishment of the Center;
b.
Draft the necessary Memorandum of Agreement (MOA) and/or its amendment regarding the Center's site, structures, governance, organization, operations, and development.
c.
Ensure the execution and publication of the MOA; and
d.
Perform such other functions necessary for the effective implementation of this Act.

SEC 3.1.Stakeholder Participation. To ensure the successful implementation of the Center's programs, projects and activities, the Center shall undertake consultations with other national government agencies and other stakeholders, including, but not limited to, the Department of Education, Department of Tourism, Department of Environment and Natural Resources, National Museum of the Philippines, National Historical Commission of the Philippines, Cultural Center of the Philippines, National Archives of the Philippines, National Library of the Philippines, Komisyon sa Wikang Filipino, Film Development Council of the Philippines, National Book Development Board, National Council for Children's Television, Design Center of the Philippines, and Philippine Creative Industry Development Council, Biliran Province State University, and other national, regional associations, and local culture and arts councils that may be recommended by the Provincial Government of Biliran.


Rule III

FUNCTIONS

SEC. 4. To fulfill its purposes and achieve its objectives, the Biliran Cultural Center and Museum shall:

4.1.
Compile the musical notes and lyrics of Biliran traditional songs, ballads, and contemporary music compositions, and collect samples of musical instruments of Biliran origin, design, and creation;
4.2.
Acquire and display a varied range of Biliran arts and artifacts;
4.3.
Publish and disseminate Biliran literacy works, epics, stories, and historical accounts;
4.4.
Compile Biliran literature, film, or audio-visual recordings of cultural performances in music, dance, oral literature, and festival celebrations;
4.5.
Compile Biliran works, names of barangays, towns and other places of interests and their respective history;
4.6.
Gather and document Biliran religious practices and traditions, and the background and origin of Biliran fiestas and festivals;
4.7.
Compile photographs of and showcase by appropriate exhibits, Biliran landmarks, historical sites and scenic views;
4.8.
Gather specimens of archaeological findings, and collect major minerals present in Biliran, namely, gypsum, sulfur, and white clay and such other geological materials unique to Biliran in coordination with the concerned cultural agency such as the National Museum of the Philippines and the like;
4.9.
Preserve by appropriate methods samples of flora and fauna to the Province of Biliran;
4.10.
Conduct performances on local music, dances, arts, literary works, epics, stories, historical accounts and legends; and
4.11.
Carry out any other relevant and appropriate activities, such as but not limited to the following:
4.11.1
Maintain and update an inventory with proper evaluation and documentation of all cultural properties within Biliran;
4.11.2
Document the traditional and contemporary arts and crafts of Biliran, including their processes and makers and sustain the sources of their raw materials;
4.11.3
Conduct field assessment/verification of sites in coordination with the NCCA pursuant to Section 28 of Republic Act No. 10066;
4.11.4
Provide free use of venues and facilities to NCCA funded activities provided that reasonable amount for utilities and direct costs may be charged; and
4.11.5
Assume the responsibility of maintaining and updating an inventory, evaluation and documentation of all cultural properties within Biliran.


Rule IV

SITE, MAIN VENUE AND ANCILLARY OFFICES

SEC. 5. The Provincial Government of Biliran shall provide the land necessary fo the construction or establishment, or both of the main venue and ancillary offices and facilities of the Biliran Cultural Center and Museum. For this purpose, with the power of LGUs under Section 18 of R.A. No. 7160, or the Local Government Code (LGC) of 1991, and Title II, Chapter 3 of the LGC, the Sangguniang Panlalawigan (SP) of Biliran shall issue the necessary Resolution and Ordinance, granting the site, main venue and ancillary offices of the Center, within three months from the publication of the MOA, or within the earliest period allowable under the LGU's legislation rules, from the publication of the MOA.


Rule V

BUDGET

SEC. 5. The amount necessary for the implementation of this Act shall be charged against the current year's budget of the NCCA. Thereafter, such amount as may be necessary for its continued implementation shall be included in the annual General Appropriations Act.


Rule VI

AMENDMENTS

SEC. 6.Amendments. Any amendments to this Implementing Rules and Regulations (IRR) shall be approved by the NCCA Board of Commissioners, in coordination with the Provincial Government of Biliran, other concerned agencies of the government, and private stakeholders.


Rule VII

FINAL PROVISIONS

SEPARABILITY AND EFFECTIVITY

CLAUSES

SEC. 7.Separability Clause. If any provision of this IRR is held invalid or unconstitutional, the other provisions not so declared shall remain in force and effect.

SEC. 8.Effectivity. This IRR shall take effect fifteen (15) days after its publication in theOfficial Gazetteor in a national newspaper of general circulation.
