IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 11770, "AN ACT ESTABLISHING THE KALINGA CULTURAL CENTER AND MUSEUM IN THE PROVINCE OF KALINGA, DEFINING ITS PURPOSES AND OBJECTIVES, AND APPROPRIATING FUNDS THEREFOR"
<div align="justify"><p align="center">Rule I</p><p align="center">ESTABLISHMENT AND PURPOSES OF KALINGA CULTURAL CENTER AND MUSEUM</p><p align="justify">SECTION 1. There is hereby established a cultural center and museum in the Province of Kalinga, to be known as the "<em>Kalinga Cultural Center and Museum", </em>to promote culture and the arts.</p><p align="justify"> SEC. 2. It shall serve as the institutional medium for the protection, preservation, presentation and promotion of the cultural, artistic, archaeological, social, historical, religious, and philosophical heritage of the Kalinga land and its people in view of the richness of their legacies and of their relevance to their contemporary and future aspirations.</p><p align="justify"><br></p><p align="center">Rule II</p><p align="center">MANAGEMENT OF KALINGA CULTURAL CENTER AND MUSEUM</p><p align="justify">SEC. 3. The Kalinga Cultural Center and Museum, hereinafter referred to as the "Center," shall be a collaboration between the Provincial Government of Kalinga and the National Commission for Culture and the Arts (NCCA) with its concerned affiliated cultural agencies and pertinent academic and private sector partners, and members of the community, with its sites, structures, governance, organization, operations, and developments to be provided for by mutual agreement between the parties, to be executed and published within one (1) year from the effectivity of this Act.</p><p align="justify">Within thirty (30) Calendar days upon effectivity of this IRR, a Technical Working Group (TWG) shall be created, composed of representatives from the Provincial Government of Kalinga and the NCCA which shall be responsible for the following:</p><table width="100%" cellpadding="3"><tbody><tr valign="top"><td width="50"><div align="left">a.</div></td><td width="1029"><div align="justify">Act as the lead body in coordinating and collating inputs from the different stakeholders for the establishment of the Center;</div></td></tr><tr valign="top"><td><div align="left">b.</div></td><td><div align="justify">Draft the necessary Memorandum of Agreement (MOA) and/or its amendment regarding the Center's site, structures, governance, organization, operations, and development;</div></td></tr><tr valign="top"><td><div align="left">c.</div></td><td><div align="justify">Ensure the execution and publication of the MOA; and </div></td></tr><tr valign="top"><td><div align="left">d.</div></td><td><div align="justify">Perform such other functions necessary for the effective implementation of this Act. </div></td></tr></tbody></table><p align="justify"> SEC. 3.1<em> Stakeholder participation. </em>To ensure the successful implementation of the Center's programs, projects and activities, the Center shall undertake consultations with other national government agencies and other stakeholders, including, but not limited to, the Department of Education, Department of Tourism, Department of Environment and Natural Resources, National Museum of the Philippines, National Historical Commission of the Philippines, Cultural Center of the Philippines, National Archives of the Philippines, National Library of the Philippines, Komisyon sa Wikang Filipino, Film Development Council of the Philippines, National Book Development Board, National Council for Children's Television, Design Center of the Philippines, National Commission on Indigenous Peoples, Philippine Creative Industry Creative Council, Kalinga State University, St. Louis College Bulanao, the different Kalinga Bodong Councils of the concerned cultural communities, and other national, regional associations, and local culture and art councils that may be recommended by the Provincial Government of Kalinga.</p><p align="justify"><br></p><p align="center">Rule III</p><p align="center">FUNCTIONS</p><p align="justify"> SEC. 4. To fulfill its purposes and achieve its objectives, the Kalinga Cultural Center and Museum shall:</p><table width="100%" cellpadding="3" border="0"><tbody><tr valign="top"><td width="35"><div align="left">4.1</div></td><td colspan="2"><div align="justify">Compile musical notes and lyrics of Kalinga traditional songs, ballads, and contemporary music compositions, and collect samples of musical instruments of Kalinga origin, design, and creation; </div></td></tr><tr valign="top"><td width="35"><div align="left">4.2</div></td><td colspan="2"><div align="justify">Publish and disseminate Kalinga literary works, epics, stories, and historical accounts;</div></td></tr><tr valign="top"><td width="35"><div align="left">4.3</div></td><td colspan="2"><div align="justify">Compile Kalinga literature, film, or audio-visual recordings of cultural performances in music, dance, oral literature, and festival celebration;</div></td></tr><tr valign="top"><td width="35"><div align="left">4.4</div></td><td colspan="2"><div align="justify">Compile Kalinga epigrams, proverbs, legends, and the origin and etymology of Kalinga words, names of barangays, municipalities and other places of interests and their respective histories; </div></td></tr><tr valign="top"><td width="35"><div align="left">4.5</div></td><td colspan="2">Gather and document Kalinga religious practices and traditions, and the background and origin of Kalinga fiestas and festivals; </td></tr><tr valign="top"><td width="35"><div align="left">4.6</div></td><td colspan="2"><div align="justify">Compile photographs of and showcase by appropriate exhibits, Kalinga landmarks, historical sites and scenic views, and acquire and display varied range of Kalinga arts and artifacts;</div></td></tr><tr valign="top"><td width="35"><div align="left">4.7</div></td><td colspan="2"><div align="justify">Gather specimens of archaeological findings, collect stones, rocks, and other geological materials, and preserve by appropriate methods samples of flora and fauna indigenous to the Kalinga region in coordination with the concerned cultural agency such as the National Museum of the Philippines and the like; </div></td></tr><tr valign="top"><td width="35"><div align="left">4.8</div></td><td colspan="2"><div align="justify">Conduct performances on Kalinga music, dances, arts, literary works, epics, stories, historical accounts and legends; and </div></td></tr><tr valign="top"><td><div align="left">4.9</div></td><td colspan="2"><div align="justify">Carry out any other relevant and appropriate activities, such as but not limited to the following:</div></td></tr><tr valign="top"><td rowspan="5"><br></td><td width="48"><div align="left">4.9.1</div></td><td width="997">Maintain and update an inventory with proper evaluation and documentation of all cultural properties within Kalinga; </td></tr><tr valign="top"><td><div align="left">4.9.2</div></td><td><div align="justify">Document the tradition and contemporary arts and crafts of Kalinga, including their processes and makers and sustain the sources of their raw materials; </div></td></tr><tr valign="top"><td><div align="left">4.9.3</div></td><td><div align="justify">Conduct field assessment/verification of sites in coordination with the NCCA pursuant to Section 28 of Republic Act No. 10066; </div></td></tr><tr valign="top"><td><div align="left">4.9.4</div></td><td><div align="justify">Provide free use of venues and facilities to NCCA funded activities provided that reasonable amount for utilities and direct costs may be charged; and</div></td></tr><tr valign="top"><td><div align="left">4.9.5</div></td><td><div align="justify"> Assume the responsibility of maintaining and updating an inventory, evaluation and documentation of all cultural properties within Kalinga. <br></div><div align="justify"><br></div></td></tr></tbody></table><p align="center">Rule IV</p><p align="center">SITE, MAIN VENUE AND ANCILLARY OFFICES</p><p align="justify">SEC. 5. The Provincial Government of Kalinga shall provide the land necessary for the construction of establishment, or both of the main venue and ancillary offices and facilities of the Kalinga Cultural Center and Museum. For this purpose, with the power of the LGUs under Section 18 of R.A. No. 7160, or the Local Government Code (LGC) of 1991, and Title II, Chapter 3 of the LGC, the Sangguniang Panlalawigan (SP) of Kalinga shall issue the necessary Resolution ad Ordinance, granting the site, main venue, and ancillary offices of the Center, within three months from the publication of the MOA, or within the earliest period allowable under the LGU's legislation rules, from the publication of the MOA.</p><p align="justify"><br></p><p align="center">Rule V</p><p align="center">BUDGET</p><p align="justify"> SEC. 6. The amount necessary for the implementation of this Act shall be charged against the current year's budget of the NCCA. Thereafter, such amount as may be necessary for its continued implementation shall be included in the annual General Appropriations Act.</p><p align="justify"><br></p><p align="center">Rule VII</p><p align="center">AMENDMENTS</p><p align="justify"> SEC. 7.<em> Amendments.</em> Any amendments to this Implementing Rules and Regulations (IRR) shall be approved by the NCCA Board of Commissioners, in coordination with the Provincial Government of Kalinga, other concerned agencies of the government, and private stakeholders.</p><p align="justify"><br></p><p align="center">Rule VIII</p><p align="center">FINAL PROVISIONS</p><p align="center">SEPARABILITY AND EFFECTIVITY</p><p align="center">CLAUSES</p><p align="justify"> SEC. 8. <em>Separability Clause. </em>If any provision of this IRR is held invalid or unconstitutional, the provisions not so declared shall remain in force and effect.</p><p align="justify"> SEC. 9.<em> Effectivity. </em>This IRR shall take effect fifteen (15) days after its publication in the Official Gazette or in a national newspaper of general circulation.</p><p align="justify"><br></p><p align="right">APPROVED: June 22, 2023</p> <table width="100%" cellpadding="3"><tbody><tr align="center"><td>(Sgd.)
