IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 11771, "AN ACT ESTABLISHING THE CAGAYAN DE ORO CITY CULTURAL CENTER AND MUSEUM IN CAGAYAN DE ORO CITY, PROVINCE OF MISAMIS ORIENTAL, DEFINING ITS PURPOSES AND OBJECTIVES, AND APPROPRIATING FUNDS THEREFOR"
Rule I
ESTABLISHMENT AND PURPOSES OF CAGAYAN DE ORO CULTURAL CENTER AND MUSEUM
SECTION 1. There is hereby established a cultural center and museum in the Cagayan de Oro City, Province of Misamis Oriental, to be known as the "Cagayan de Oro City Cultural Center and Museum" to promote culture and the arts.
SEC. 2. It shall serve as the institutional medium for the protection, preservation, presentation and promotion of the cultural, artistic, archaeological, social, historical, religious and philosophical heritage of the city and its people in view of the richness of their legacies and of their relevance to their contemporary and future aspirations.
Rule II
MANAGEMENT OF CAGAYAN DE ORO CITY CULTURAL CENTER AND MUSEUM
SEC. 3. The Cagayan de Oro City Cultural Center and Museum, hereinafter referred to as the "Center," shall be a collaboration between the City Government of Cagayan de Oro and the National Commission for Culture and the Arts (NCCA) with its concerned affiliated cultural agencies and pertinent academic and private sector partners, and members of the community, with its site, structures, governance, organization, operations, and development to be provided for by mutual agreement between the parties, to be executed and published within one (1) year from the effectivity of this Act.
Within thirty (30) Calendar days upon effectivity of this IRR, a Technical Working Group (TWG) shall be created, composed of representatives from the City Government of Cagayan de Oro City and the NCCA which shall be responsible for the following:
| a. | Act as the lead body in coordinating and collating inputs from the different stakeholders for the establishment of the Center. |
| b. | Draft the necessary Memorandum of Agreement (MOA) and/or its amendment regarding the Center's site, structures, governance, organization, operations, and development; |
| c. | Ensure the execution and publication of the MOA; and |
| d. | Perform such other functions necessary for the effective implementation of this Act. |
Section 3.1.Stakeholder Participation. To ensure the successful implementation of the Center's programs, projects and activities, the Center shall undertake consultations with other national government agencies and other stakeholders, including, but not limited to, the Department of Education, Department of Tourism, Department of Environment and Natural Resources, National Museum of the Philippines, National Historical Commission of the Philippines, Cultural Center of the Philippines, National Archives of the Philippines, National Library of the Philippines, Komisyon sa Wikang Filipino, Film Development Council of the Philippines, National Book Development Board, National Council for Children's Television, Design Center of the Philippines, and the Philippine Creative Industries Council, and other national, regional associations, and local culture and arts councils that may be recommended by the City Government of Cagayan de Oro.
Rule III
FUNCTIONS
SEC. 4. To fulfill its purposes and achieve its objectives, the Cagayan de Oro City Cultural Center and Museum shall:
| 4.1 | Compile musical notes and lyrics of Higaonon and other tribes' ancestral songs, traditional songs and ballads, and modern and contemporary music compositions, and collect samples of musical instruments of local origin, design, and creation; | |
| 4.2 | Publish and disseminate Cagayan de Oro's literary works, epics, stories, and historical accounts; | |
| 4.3 | Compile Cagayan de Oro City's literature, film, or audio-visual recordings of cultural performances in music, dance, oral literature, and festival celebration; | |
| 4.4 | Compile Cagayan de Oro City's epigrams, proverbs, legends, and the origin, history and etymology of the city, its words, names of barangays, and other places of interests and their respective histories; | |
| 4.5 | Gather and document Cagayan de Oro City's religious practices and traditions, and the background and origin of the local fiestas and festivals; | |
| 4.6 | Compile photographs of and showcase by appropriate exhibits, local landmarks, historical sites and scenic views, and acquire and display varied range of local arts and artifacts; | |
| 4.7 | Gather specimens of archaeological findings, collect stones, rocks, and other geological materials, and preserve by appropriate methods samples of flora and fauna indigenous to the city and its environs in coordination with the concerned cultural agency such as the National Museum of the Philippines and the like; | |
| 4.8 | Conduct performances on local music, dances, arts, literary works, epics, stories, historical accounts and legends; and | |
| 4.9 | Carry out any other relevant and appropriate activities, such as but not limited to the following: | |
4.9.1 | Maintain and update an inventory with proper evaluation and documentation of all cultural properties within Cagayan de Oro; | |
4.9.2 | Document the tradition and contemporary arts and crafts of Cagayan de Oro, including their processes and makers and sustain the sources of their raw materials; | |
4.9.3 | Conduct field assessment/verification of sites in coordination with the NCCA pursuant to Section 28 of Republic Act No. 10066; | |
| 4.9.4 | Provide free use of venues and facilities to NCCA funded activities provided that reasonable amount for utilities and direct costs may be charged; and | |
4.9.5 | Assume the responsibility of maintaining and updating an inventory, evaluation and documentation of all cultural properties within Cagayan de Oro. |
Rule IV
SITE, MAIN VENUE AND ANCILLARY OFFICES
SEC. 5. The City Government of Cagayan de Oro shall provide the land necessary for the construction or establishment, or both of the main venue and ancillary offices and facilities of the Cagayan de Oro City Cultural Center and Museum. For this purpose, with the power of the LGUs under Section 18 of R.A. No. 7160, or the Local Government Code (LGC) of 1991, and Title II, Chapter 3 of the LGC, the local legislative body of the City of Cagayan de Oro shall issue the necessary Resolution and Ordinance, granting the site, main venue and ancillary offices of the Center, within three months from the publication of the MOA, or within the earliest period allowable under the LGU's legislation rules, from the publication of the MOA.
Rule V
BUDGET
SEC. 6. The amount necessary for the implementation of this Act shall be charged against the current year's budget of the NCCA (Proper). Thereafter, such amount as may be necessary for its continued implementation shall be included in the annual General Appropriations Act.
Rule VII
AMENDMENTS
SEC. 7.Amendments.Any amendments to this Implementing Rules and Regulations (IRR) shall be approved by the NCCA Board of Commissioners, in coordination with the City Government of Cagayan de Oro, other concerned agencies of the government, and private stakeholders.
Rule VIII
FINAL PROVISIONS
SEPARABILITY AND EFFECTIVITY
CLAUSES
SEC. 8.Separability Clause. If any provision of this IRR is held invalid or unconstitutional, the other provisions not so declared shall remain in force and effect.
SEC. 9.Effectivity. This IRR shall take effect fifteen (15) days after its publication in theOfficial Gazetteor in a national newspaper of general circulation.
