REPUBLIC ACT NO. 3537 AN ACT AMENDING SECTION THIRTY-EIGHT OF REPUBLIC ACT NUMBERED FOUR HUNDRED NINE, AS AMENDED BY REPUBLIC ACT NUMBERED THREE THOUSAND TEN. June 20, 1963

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

SECTION 1. Section thirty-eight of Republic Act Numbered Four hundred nine, as amended by Republic Act Numbered Eighteen hundred sixty and Republic Act Numbered Three thousand ten, is further amended to read as follows:

"SEC. 38.The City Fiscal and Assistant City Fiscals.— There shall be in the Office of the City Fiscal one chief to be known as the City Fiscal with the rank, salary and privileges of a Judge of the Court of First Instance, an assistant chief to be known as the first assistant city fiscal, three second assistant city fiscals who shall be the chiefs of divisions, and fifty-seven assistant fiscals, who shall discharge their duties under the general supervision of the Secretary of Justice.  To be eligible for appointment as City Fiscal one must be a natural born citizen of the Philippines and must have practiced law in the Philippines for a period of not less than ten years or held during a like Period an office in the Philippine Government requiring Emission to the practice of law as an indispensable requisite.  To be eligible for appointment as assistant fiscal must be a natural born citizen of the Philippines and must have practiced law for at least five years prior to his appointment or held during a like period an office in the Philippine Government requiring admission to the practice of as an indispensable requisite,

"The City Fiscal and his assistants shall receive the salaries hereinafter set forth, which shall be paid by the City of Manila:

"(a) City Fiscal, with the rank, salary and privileges of a Judge of the Court of First Instance.

"(b) First assistant city fiscal, fifteen thousand pesosper annum.

"(c) Three second assistant city fiscals who shall be the chief of the three divisions, fourteen thousand four hundred pesosper annumeach.

"(d) Six assistant fiscals, thirteen thousand two hundred pesosper annumeach.

"(e) Six assistant fiscals, twelve thousand six hundred pesosper annumeach.

"(f) Six assistant fiscals, twelve thousand pesosper annumeach.

"(g) Six assistant fiscals, eleven thousand four hundred pesosper annumeach.

"(h) Six assistant fiscals, ten thousand eight hundred pesosper annumeach.

"(i) Six assistant fiscals, ten thousand two hundred pesosper annumeach.

"(j) Six assistant fiscals, nine thousand six hundred pesosper annumeach.

"(k) Five assistant fiscals, nine thousand pesosper annumeach, Five assistant fiscals, eight thousand four hundred pesosper annumeach.

"(l) Five assistant fiscals, seven thousand eight hundred pesosper annumeach."

SEC. 2. All incumbent fiscals of the City of Manila occupying positions affected by the preceding section at the time of the approval of this Act shall continue to occupy their respective positions and receive the salary increase herein provided without the necessity of any appointment.SEC. 3. This Act shall take effect upon its approval.Approved, June 20, 1963.
