STREAMLINING THE INITIATIVES OF THE OFFICE OF THE PRESIDENT ON INVESTMENT AND ECONOMIC AFFAIRS
WHEREAS, Section 1 of Executive Order (EO) No. 49 (s. 2023) created the Office of the Special Assistant to the President for Investment and Economic Affairs (OSAPEIA) in the Office of the President (OP) to ensure effective integration, coordination, and implementation of various investment and economic policies and programs of the Government;
WHEREAS,Sections 3 and 4 of EO No. 49 provide that the Special Assistant to the President for Investment and Economic Affairs (SAPIEA) shall serve as: (a) Chairperson of the Economic Development Committee (EDCom); and (b) Member of the following committees of the Economic Development (ED) Council: (i) Development Budget Coordination Committee (DBCC); (ii) Investment Coordination Committee (ICC); (iii) Infrastructure Committee (INFRACOM); and (iv) Social Development Committee (SDC);
WHEREAS,Section 1 of Administrative Order (AO) No. 37 (s. 2025) provides that the SAPIEA shall serve as a Member of the ED Council;
WHEREAS,under Section 2 of AO No. 31 (s. 2025), the Semiconductor and Electronics Industry Advisory (SAPIEA) Council, which is the primary advisory body to the President on matters related to the development, promotion, and competitiveness of the semiconductor and electronics industry in the country, shall led by the SAPIEA as Chairperson;
WHEREAS,there is a need to further streamline the initiatives of the OP on investment and economic affairs to further establish a robust monitoring system and ensure a more holistic and cohesive approach to address the diverse economic challenges currently confronting the nation;
WHEREAS,Sections 23 and 25 of Republic Act (RA) No. 12145 or the "Economy, Planning and Development Act" authorize the President to reorganize the composition of the ED Council and its Committees whenever necessary for the effective performance of their functions;
WHEREAS,Section 31, Chapter 10, Title III of EO No. 292 or the "Administrative Code of 1987" provides that the President, in order to achieve simplicity, economy and efficiency, shall have the continuing authority to reorganize the administrative structure of the OP; and
WHEREAS,Section 17, Article VII of the Constitution confers to the President the power of control over all Executive departments, bureaus, and offices, and the mandate to ensure the faithful execution of laws;
NOW, THEREFORE, I, FERDINAND R. MARCOS, JR.,President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:
Section 1. Abolition.The OSAPIEA is hereby abolished. The powers, duties, and functions of OSAPIEA, except those that are within the powers, duties, and functions of other concerned agencies in accordance with their respective mandates, shall now be integrated into the Office of the Executive Secretary (OES).
All records, documents, resources, office, spaces, and other properties in custody of or are being used by the OSAPIEA shall be turned over the OES, subject to existing laws, rules and regulations. As may be necessary, the existing personnel in OSAPIEA shall be transferred to the OES, subject to existing laws, rules, and regulations.
Section 2. EDCom.The Secretary of Department of Finance shall serve as Chairperson of the EDCom, and as such, shall continue to exercise oversight over strategic investment priorities and agenda.
The Secretary of the Department of Economy, Planning, and Development shall serve as Vice Chairperson of the EDCom.
Pursuant to RA No. 12145, a representative designated by the OP shall remain as Member of EDCom.
Section 3. SEIA Council.The Executive Secretary shall now serve as the Chairperson of the SEIA Council. The Vice Chairperson and Members of the SEIA Council shall remain consistent with AO No. 31.
Section 4. Separability.If any section or part of this Order is declared unconstitutional or invalid, the other sections or provisions not otherwise affected shall remain in full force and effect.
Section 5. Repeal.If any section or part of this Order is declared unconstitutional or invalid, the other sections or provisions not otherwise affected shall remain in full force and effect.
Section 6.Effectivity.This Order shall take effect immediately upon its publication in the Official Gazette or in a newspaper of general circulation.
