OPERATIONS ORDER NO. JHM-2018-008 REVISED GUIDELINES ON THE DEPORTATION OF FOREIGNER CLAIMED BY VARIOUS FOREIGN AGENCIES April 02, 2018

WHEREAS,there are instances when a deportable foreigner is claimed by various foreign agencies;

WHEREAS, the  issue  on  which  foreign  agency  should  the  deportable foreigner be released arises;

WHEREAS,there is a need to set concrete guidelines on this issue;

NOW THEREFORE,pursuant to the rule-making authority of the Commissioner of Immigration under relevant immigration laws, the following shall be observed:

Subject to the provisions of CA 613, Secs. 36 and 38, a deportable foreigner shall be deported to the country of his declared nationality via the presented foreign passport at the port of entryunless otherwise directed by the Department of Justice.

Furnish a copy of this Order to the Office of the National Administrative Register (ONAR), U.P. Law Center, U.P. Diliman, Quezon City
