MIA MARINA Advisory No. 2015-07 BAN ON THE USE OF SECOND (UPPER) DECK FOR PASSENGER ACCOMMODATION AND CARGO STOWAGE FOR ALL MOTOR BANCAS WITH SECOND (UPPER) DECK July 06, 2015

Effective immediately notice is hereby given that pursuant to Presidential Decree No. 474, E0 125/125-A, Republic Act No. 9295 and its Revised IRR and to further ensure safety of ships, this Authority herebyPROHIBITS the use of the SECOND (UPPER) DECK for accommodation of passengers and/or stowage of cargoes for all motor bancas with second (upper) deck.

Furthermore, allmotor bancas with second (upper) deckshall beimmediatelysubjected to re-evaluation and re-inspection following the procedures prescribed below:

1. Review of approved plans including stability and load markings;
   
2. Conduct of re-inspection of motor bancas with second (upper) deck in coordination with the Maritime Regional Offices. Motor bancas who fail to comply with MC 65, MC 2007-04 and other-relevant rules and regulations shall be restricted to single deck banca operation; and,
   
3. Check load markings, to verify calculations vis-à-vis its existing Certificate of Load Marking. A new Certificate shall be re-issued to reflect the validated/verified calculation.
