PENALIZING THE TRAINER FOR THE JOCKEY’S USE OF WRONG RACING COLOR



WHEREAS, the Philippine Racing Commission (PHILRACOM) has the exclusive jurisdiction and control over all aspects of horseracing as provided in Presidential Decree No. 420;

WHEREAS, the PHILRACOM in its Horseracing rules and regulations penalizes the owner for his jockey’s use of wrong racing color;

WHEREAS, upon recommendation of the Review Committee of the PHILRACOM, it is proposed that it should be the trainer, not the owner, who should be penalized for their jockey’s use of wrong racing color because the trainers oversees all the concerns/ responsibilities of the owner in the latter’s horses;

WHEREAS, it was also proposed that for the jockey’s use of wrong racing color, the trainer should be penalized as follows: 

1stoffense – Php 1,000.00
2ndoffense – Php 2,000.00
3rdoffense – Php 3,000.00

NOW, THEREFORE, the PHILRACOM Board of Commissioners resolved, as it hereby resolves, that it should be the trainer, not the owner, who should be penalized for their jockey’s use of wrong racing color because the trainers oversees all the concerns/ responsibilities of the owner in the latter’s horses;

RESOLVED FURTHER, that for the jockey’s use of wrong racing color, the trainer should be penalized as follows:

1stoffense – Php 1,000.00
2ndoffense – Php 2,000.00
3rdoffense – Php 3,000.00

RESOLVED FINALLY, that a copy of this resolution be furnished the horseowners, trainers, jockeys, and all persons concerned for their proper guidance and the same be published in the Kopya and furnished the UP Law Center for proper publication.
