MMDA RESOLUTION NO. 02-52, s. 2002 AMENDING SECTION 5 SUBSECTION 3 OF THE MMDA GUIDELINES ON TOWING AND IMPOUNDING OPERATIONS IN METRO MANILA APPROVED BY THE METRO MANILA COUNCIL THRU MMDA NO. 02-33, S. 2002 November 07, 2002

WHEREAS, on August 29, 2002, MMDA Resolution No. 02-33 entitled "Approving and Adopting the Revised MMDA Guidelines for Towing and Impounding Operations in Metro Manila" was approved by the Metro Manila Council (Council) to address the urgent need to implement uniform procedures and guidelines on towing and impounding operations in Metro Manila;

WHEREAS, Section 5 subsection 3 of the approved MMDA Guidelines on Towing and Impounding Operations provides that: 

"Towing companies must submit a surety bond for each tow truck requested for accreditation to answer for any loss or damage incurred in towing vehicles. Towing company/agency shall be required to pay a surety bond of P100,000.00 per tow truck";

WHEREAS, the Council in session duly assembled, proposed and agreed to require a lower surety bond for each tow truck to be accredited.

NOW, THEREFORE, pursuant to Section 6 of R.A. 7924, this Resolution is hereby adopted and promulgated by the Council that Section 5 subsection 3 of the MMDA guidelines on towing and impounding operations in Metro Manila be amended to read as follows: 

"Towing company/agency shall be required to post a surety bond of P10,000.00 per tow truck. The surety bond shall be pooled together to pay for any claim against any tow truck. The said claim shall be reimbursed to the MMDA by the concerned towing company".
