ADDITIONAL AMENDMENTS TO CHAPTER VI
Please be informed that the Commission, in its meeting held on December 2, 2002, after due deliberation, resolved to amend by addition the following Sections of the Horseracing Rules and Regulations, to wit:
1. SECTION 42.1 —DURING THE RACE:
c. FOR CARELESSNESSOR FAILING TO ALLOW HIS MOUNT TO RUN ON ITS MERITS— To obtain the best possible placing includingplacingsin exotic bets. (8 racingweekssuspension)
2. RE-GROUPING SIMILAR PENALTIES IN SEC. 42.2:
SECTION 42.2 AFTER THE RACE:
FOR HAVING LESS WEIGHT:
c. for havingless weight, of one (1) kilogram and below when weighed after using the allowable weight allowance,not having finished first, second, third, fourth or placers of exotic bets, by a fine ofONE THOUSAND PESOS (P1,000.00):
However, if the weight is less:
1-1 — 1.5 kgs. - bysuspension of two (2) racing weeks
1.6 — 2 kgs. - bya suspension of four (4) racing weeks
morethan 2 kgs. - bya suspension of eight (8) racing weeks
1. for havingless than the assigned weight after using the allowable weight allowance, having finished first, by a suspension of one (1) year;
2. A suspension of twenty six (26) racing weeks shall be imposed on jockeys for havingless than the assigned weight after the racehavingfinished second, third, fourth or placers of exotic bets;
3. Horses whose jockeys having less than the assigned weight after using the allowableweight allowance having finished first, second, third, fourth or placers of exotic bets shall be disqualified;
e. for using any of his riding paraphernalia to complete his required handicap weight, by a fine of ONE THOUSAND PESOS (P1,000.00)
FOR HAVING MORE WEIGHT
f. The following penalties shall be imposed, for carrying more than the assigned weight including the allowable weight allowance, unless such excess weight has been caused by rain or mud, having finished first, second, third, fourth or placers of exotic bets:
1 kg. and below - | by suspension of one (1) racing week or a fine of P1,000.00 |
1.1 — 1.5kgs. - | by a suspension of four (4) racing weeks |
1.6 — 2kgs. - | by a suspension of eight (8) racing weeks |
morethan 2kgs. - | by a suspension of twenty six (26) racing (8) racing weeks; |
1. for having more weight, when weighted after using the allowable weight allowance, unless such excess weight has been caused by rain or mud not having finished first, second, third, fourth, or placers of exotic bets by fine of One Thousand Pesos (P1,000.00) of the excess weight is one (1) kilogram and below.
However, if the excess weight is:
1.1 — 1.5kgs. - | by a suspension of four (4) racing weeks |
1.6 — 2kgs. - | by a suspension of eight (8) racing weeks |
morethan 2kgs. - | by a suspension of twenty six (26) racing weeks; |
3. SECTION 45. PENALTIES FOR RACE HORSES:
45.0 c — 1. Horses which are unmanageable, uncontrollable, hostile while entering the starting gate within a period of three (3)minutes and/or behaves in any way that is analogous to the foregoing, as determined by the Board of Stewards;
2. Horses acting up or hostile while inside the stall of the starting date as reported by the starterand/or behaves in any way that is analogous to the foregoing, as determined by the Board of Stewards;
shallbe penalized as follows:
1st offense barrier trial
andSubsequent Offenses
However, horses that refuse to enter the starting gate, after an additional two (2) minutes time, shall automatically be scratched.
4. REMOVAL OF WORD "IN THE SAME TRACK" IN SEC. 45.3A AND THE IMPLEMENTING GUIDELINES
SECTION 45.3 SUDDEN REVERSAL OF FORM. — For sudden reversal of form or inconsistency in its performance within a period of three racing weeks from its last outing, a horse shall be suspended for at leastninety (90) calendar days;
45.3-A — In rendering a decision, the Stewards shall take into account as far as practicable the following: track condition; the performance of the horseWITHIN THE PAST FOUR (4) RACING WEEKScompared to the present performance; the time difference should be four (4) seconds or more for a horse to be considered for sudden reversal of form; the class or grouping of the compared to the previous company; the present condition, characteristics, including sex and age, and running style of the horse; the trip of the horse in the course of the race or how the race was run by a particular horse; the jockey's class, ability and riding style; the testimony of the jockey; the current handicap weight compared to the previous weight carried by the horse; and the weather condition at the time the race was run.
This rule shall take effect fifteen days after publication.
