DIRECTING THE EXPEDITED DEVELOPMENT OF THE SANGLEY POINT INTERNATIONAL AIRPORT



WHEREAS,Section 2 of Republic Act No. 11032, or the "Ease of Doing Business and Efficient Government Service Delivery Act of 2018," declares it a policy of the State to take appropriate measures to promote transparency in each agency with regard to the manner of transacting with the public, which shall encompass initiating and maintaining a program for the adoption of simplified procedures that will reduce red tape and expedite business and non-business transactions in government;

WHEREAS,Executive Order No. 629 (s. 2007) directed the Philippine Reclamation Authority (PRA) to develop the Sangley Point in Cavite into an International Logistics Hub with container port and airport complex, and constituted an Executive Committee and Inter-Agency Technical Committee to oversee and support the planning, implementation, and monitoring of the Project;

WHEREAS,in 2022, the Provincial Government of Cavite (PGC) identified the Sangley Point International Airport (SPIA) as a flagship local public-private partners, and streamline regulatory and administrative processes, in order to ensure the timely completion of the SPIA; and

WHEREAS,Section 17, Article VII of the Constitution vests in the President the power of control over all Executive departments, bureaus, and offices,a and the mandate to ensure the faithful execution of laws.

NOW, THEREFORE, I,FERDINAND R. MARCOS, JR.,President of the Philippines, by virtue of the powers vested in me by law, do hereby order the following:

Section 1. Expedited Development of the SPIA.Subject to existing laws, rules, and regulations, all concerned national government agencies and instrumentalities, including government-owned or -controlled corporation (GOCCs) and government financial institutions are hereby directed, and LGUs in the province of Cavite are hereby encouraged to:


 a.
Prioritize and expedite the processing of all permits, clearances, licenses, certifications, and other authorizations required for the implementation of the SPIA Project;

 b.
Adopt and implement measures to streamline procedures and eliminate redundancies, and prevent undue delays in the development of the SPIA Project; and

 c.
Extend full support, assistance, and cooperation to ensure the timely and unimpeded completion of the SPIA Project.

Section 2. Joint Technical Working Group (JTWG).To facilitate the expeditious development and completion of the SPIA, a JTWG is hereby constituted, to be composed of representatives from each of the following agencies:

  Department of Justice;
  Civil Aviation Authority of the Philippines (CAAP); and

Section 3. Duties and Functions of the JTWG.The JTWG shall perform the following duties and functions:

 a.
Address issues arising from the timely development of the SPIA Project, subject to existing laws, rules and regulations;

 b.
Ensure effective governance of reclamation activities, as may be authorized and strict compliance with environmental and technical requirements under applicable laws, rules and regulations;

 c.
Submit quarterly progress reports to the President, through the Office of the Executive Secretary, detailing milestones and compliance actions, issues encountered, and recommendations for resolution of the President;

 d.
Recommend to the President policy directives necessary to sustain implementation timelines and ensure alignment with national development priorities; and

 e.
Perform such other functions as may be necessary to carry out the objectives of this Order, or as may be directed by the President, through the Executive Secretary.

Section 4. Agency Directives.Consistent with their respective mandates and subject to applicable laws, rules and regulations, the following agencies are hereby directed to undertake the actions set forth below in support of the timely and efficient implementation of the SPIA Project:

 a.
The DOTr shall provide overall air transport and civil aviation policy direction, and shall coordinate government actions and measures for the implementation of the SPIA Project in order to support safe, reliable, efficient, and convenient air travel and to facilitate the integration of the SPIA Project into the Greater Capital Region Airport System and the national air transport network;

 b.
The CAAP shall exercise technical regulatory oversight over the planning, design, development, and operational readiness of the airport, including the issuance of the necessary certifications and authorizations in accordance with applicable laws and standards; and

 c.
The PRA shall exercise regulatory and technical oversight over the reclamation component of the SPIA Project, including the review and approval of reclamation plans, enforcement of technical standards and compliance requirements, and to ensure that all reclamation activities are undertaken in accordance with applicable laws, rules and regulations.

  
The PRA is hereby directed to review and rationalize applicable fees and charges in relation to the non-saleable reclamation component of the SPIA Project, consistent with applicable laws, rules, and regulations.

Section 5. Availability and Use of Sangley Point Land.The JTWG, in coordination with other concerned government agencies, is hereby directed to take all necessary actions to ensure that the Sangley Point land is available for the development and implementation of the SPIA.

Section 6. Environmental Safeguards.All agencies and proponents shall ensure that compliance with the Environmental Impact Statement System, the Environmental Compliance Certificate, the conditions in the Letters of No Objection and Area Clearance, and related laws, rules, and regulations. Environmental monitoring mechanisms shall be established by the DENR and PRA to safeguard marine and coastal ecosystems affected by reclamation and construction activities.

Section 7. Separability.If any part or provision of this Order is declared unconstitutional or invalid, the other provisions not affected shall continue to be in full force and effect.

Section 8. Repeal.All orders, rules, regulations, and  issuances or parts thereof  inconsistent with this Order, are hereby repealed, amended or modified accordingly.

Section 9. Effectivity.This Order shall take effect immediately upon its publication in the Official Gazette or a newspaper of general circulation.
