AMENDING ADMINISTRATIVE ORDER NO. 267 (S. 1992) BY AUTHORIZING THE DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT SECRETARY TO DELEGATE THE AUTHORITY TO APPROVE THE FOREIGN TRAVEL OF LOCAL OFFICIALS
WHEREAS,the President exercises general supervision over local governments pursuant to Section 4, Article X of the Constitution; Section 18, Chapter 6. Title I, Book III of Executive Order No. 292 (s. 1987) or the "Administrative Code of 1987," and Section 25, Article I, Chapter III, Title I, Book I of Republic Act (RA) No. 7160 or the "Local Government Code of 1991;"
WHEREAS,Section 96(c), Title III, Book I of RA No. 716o provides that local government officials travelling abroad are required to secure permission from the Office of the President when the period of travel extends to more than three (3) months, during periods of emergency of crisis, or when the travel involves the use of public funds;
WHEREAS,Administrative Order (AO) No. 267 (s. 1992) delegated certain supervisory powers of the President over local governments to the Secretary of the Interior and Local Government, including the approval of foreign travel of local government officials pursuant to Section 96(c) of RA No. 7160;
WHEREAS,Executive Order No. 77 (s. 2019) prescribes the rules and regulations for the official local and foreign travels of government personnel;
WHEREAS,considering the volume of travel requests and the increasing demands of regional coordination, there is a need to refine approval processes to ensure responsiveness amid contemporary government realities, strengthen government systems and improve bureaucratic efficiency, while also maintaining sufficient oversight and supervision over local governments; and
WHEREAS,Section 17, Article VII of the Constitution vests in the President the power of control over all executive departments, bureaus, and offices;
NOW, THEREFORE, I, FERDINAND R. MARCOS, JR.,President of the Republic of the Philippines, by the virtue of the powers vested in me by the Constitutions and existing laws, do hereby order:
Section 1.A new section designated as Section 1-A is herebyinsertedto read as follows:
"Section 1-A. The Secretary of the Interior and Local Government is authorized to further delegate the authority under Section 1(d) to his/her designated representative/s." |
